ADAM, Mrs. Mary.  Braybrook, to adopt Clarence, child of Janet BLAIR in 1904; 4 pages, , List 6.

ADAMS, Fanny.  In 1904, while living at Carlton, applied to become registered so she could take care of her sister Margaret TINKER’s illegitimate child, falsely registered as James Joseph PHILLIPS.  Margaret came from Bushfield near Warrnambool.  22 pages, List 10.

ADAMS, Jane, wrote from Golden Square in 1902, has taken child Ada CRAWFORD.  4 pages, List 18.

ADAMS, Mary.  Richmond, widow, 1894, took child Verdon Wallace ABSOLUM for her sister Mrs. WHITTAKER, but child died.  7 pages, List 6.

AGAR, Mrs. E., South Yarra, wrote in 1898, seeking exemption from registering as a nurse. The mother of the child FORGON was in an asylum, and the husband and children lived with her.

AITKEN, Mrs., Prahran, wanted to adopt Olive Myrtle ALLEN, mother in W. Aust and about to be married. Police find the mother is to pay Aitken for doing so, which is not allowed under the Act. 1898

ALDOWS, A. Brighton. Registered as a nurse in 1893, has a child, unnamed; new premises described.

ALDUS, Margaret A., Ararat, nurse,  has handed illegitimate child Muriel W. BLACK to her father (named), 2 pages, List 6.

ALLEN, Mrs. Charlotte.  A nurse at Bendigo, with six children of her own.  Had child Herbert STANLEY, who died in 1894; failed to report death.  Circumstances reported by Mrs. E.G. McKENZIE , ‘Bona Vista’ View St.  4 pages, List 6.

ALLENDER, Mary Anne., Ballarat East, has Lucy MARSHALL’s child Ernest Allen in 1904.  3 pages, List 10.

ALLISON, Mrs. David.  Mornington, 1901; is to look after William Henry STANLEY while is mother Jane is ill, she is her sister, List 13.

ALLUM, Margaret. Brunswick, registered as a nurse, 1893. Has a female child, unnamed.

ALSTON, Mrs. S. Brighton, registered as a nurse, 1893. Had child of Emily BLACKER, but has been removed to Mrs. RAIN of Fitzroy.

ANGOVE, George Abels.  Illegitimate child of Bessie Angove, died at unregistered nurse Margaret HOWARTH’s home at Eaglehawk in 1898.  Witness Sarah BEALE names father.  Bessie divorced and subsequently remarried William CARBIS.  25 pages, List 3.

ANSTIS, Ruby Phyllis, daughter of Elizabeth, adopted by grandmother Mrs. T. Anstis of Ballarat in 1906.  8 pages, List 24.

ARDLEY, Joseph and wife adopt Lillia ?[ file not clear on child's name. ] Mrs. EDWARDS had child firstly from Mrs. FULLER. 1898.

BAKER, Edith.  Child of Rosa Baker.  Left with nurse Mrs. Margaret SMITH in 1904; in 1905 she adopts the child and takes her to New Zealand.  T.H. DARE of Auckland complains of their action.  List 16.

BEAL, Daisy May, living with grandmother Elizabeth and Thomas PETTY at Outtrim in 1898. Assaulted by grandmother who then attempts suicide in 1898.  Mrs. Sarah SPARGO paid to look after child.  Daisy’s mother Annie writes from Sydney.  27 pages, List 18.

BETTS, – Mrs. Hamilton. Had an unnamed child, given exemption from registering as a nurse, 1893.

BIBBY, Elsie, gave birth to William Bibby in 1904 at the home of Ruby ELLIOTT in East Melbourne.  The child died and neither birth nor death was registered within the required 3 days, so Elliott was to be prosecuted, but case withdrawn as she believed Bibby was married.  9 pages, List 25. 

BILLINGTON, Mrs.,  Brighton.  Complaint of Lady Visitor E. BENT, 1898, that she is unsatisfactory; 2 infants have died in her care and a third is delicate.  Roll Book on file.  29 pages, List 3.

BOOTHMAN, Edward B., Hawthorn, charged in 1896 with being the occupier of a house in which an illegitimate child, Effie Eileen McCARTHY was born, and not registering it within 3 days as required.  Mother Margaret lives with him.  7 pages, List 26.

BROCK, Gertrude, illegitimate child of Emily, died in 1895 at home of Mirra[?] HUNTER, St. Kilda West, an unregistered nurse.  Police find mother was wet nursing the child of Mr. WILCOCKS in St. Kilda and the child was previously with Mrs. Annie SMITH of Moore St. Fitzroy, also unregistered.  12 pages, List 22.

BROWN, Thomas of Collingwood. Charged in 1899 with failure to register birth of illegitimate child Thomas Brown DEVLIN, son of Mary, within required time. 8 pages, List 2.

BROWN, John Whitfield and wife Mary Elizabeth, of Footscray.  To adopt Rose LENNY, child of William Barrington and wife Matilda, in 1901.  List 14.

BRYANT, Mrs. Selina, Northcote.  Took in neighbour’s child Lilia Pausey HEWITT in 1896.  Child’s birth was registered under name of BRENNAN, father Edward Alfred, but parents not married. Mother Frances Dorothy Hewitt was living with her sister Mrs. LAURENCE.  Bryant cared for it for 12 months, but child died.  As she was not a registered nurse she was taken to court and fined.  8 pages, List 24.

BURNS, Mary.  Auburn, applies to register as a nurse in 1894, her husband is a gardener, she has two children of her own.  Has Elsie DOWLING, the illegitimate child of her sister Annie.  6 pages, List 6.

BURRELL, Margaret. West Melbourne, registered as a nurse, 1893; had Louisa E. McCRAE, who died.

BURTON, H.C., North Melbourne, child removed from her care in 1902.  4 pages, List 7.

BURTON, Honora Cecilia.  Charged with manslaughter of infant Thomas ALGER who died in Sale in 1904.  Child had been left in her care in Melbourne by parents Louise (nee LANGFORD) and Thomas, who subsequently took it to Sale.  Burton had combined with fellow nurse Margaret HENNESSY to look after several infants.  File gives details of these two women and police belief in their innocence.  72 pages, List 17.

BURTON, Martha. File covering 1894-1899 includes her original application to be registered as a nurse; the deaths of children Mary Agnes REILLY, daughter of Agnes of Upper Murray, Mary ROSS, daughter of Mary Jane and Maria DUNN [mother not given]; also the removal of Edith WILSON by her grandmother Jane of St. Kilda and Fanny SCHULDT by her mother Elizabeth and the child of Florence BROPHY of Alexandra. Martha’s husband Archibald was a bricklayer. 46 pages, including two letters from Burton.

BURTON, Martha Jane, widow, East Brunswick, applies to be registered.  Police report she was previously registered and charged with neglect, and refuse application.  14 pages, List 2.

BUTLER, Mary.  Advises in 1898 that she has taken on the care of her daughter Catherine’s illegitimate child Agnes; resides at Horsham.  Presumed father named.  3 pages, List 6.

BUTLIN, Mary.  Nurse, Footscray, has a child.  January 1904 Monthly Report.

BYLES, E. Prahran, registered as a nurse, 1893; had Clyde LINDSAY.  CONNECTION FOUND

BYRNE, Mary.  Applied to be registered as a nurse, living in Abbotsford, married.  Police report her husband Martin in a labourer, the house is only of 4 rooms, they have 5 children and she is illiterate.  Application refused.  6 pages, List 11.

CARDINALI, Henry, Northcote, charged with failure to register illegitimate birth of Daphne Margaret HIRST, child of Margaret Hirst and himself, within 3 days. 1899.

CAREY, Mrs., Armadale.  Child Mary Louisa LENNAN died in her care in 1896; she is unregistered; court case.  10 pages, List 25. 

CARLISLE, Ivy.  Interstate arrangements to forward her to her mother in Melbourne, but foster parent decides to keep her.  2 pages, List 6.

FORSYTH/FORSYTHE, Ivy Elsie.  (very complicated story!) Born 1900, illegitimate child of Ellen/Eleanor, who was married to a Forsyth who died.  She went to live with father in law Robert Forsyth, near Stawell, and his nephew Robert John Forsyth is the father of the child.  He consequently married a Mrs. Ellen LEE, a widow ‘a coarse woman’ and mother Ellen subsequently married William STANTON.  She claimed maintenance from father, but he and his new wife take over care of the child, rather than pay amount owing.  Nurse Ellen McGINN of Horsham had the child.  List 15.

GORIN/GORING, Ellen. Falsely claimed to be married to Thomas Gorin/Goring when registering birth of child Francis Thomas Goring in Hawthorn in 1900; her real name is MADDEN. Nurse Annie JONES of Hawthorn attended her confinement and looked after the child for some months; other nurse Elizabeth FORD of Ballyrogan near Buangor, mentioned. Mrs. Gorin interviwed, and reveals that Thomas left her c1897, was a former policeman.  Madden and Gorin are working on the property Challicum Station close to Buangor. Local police recommend no prosecution as the pair are living respectably together, and looking after child; this is agreed to.  42 pages, List 2

LANE, M.J., registered nurse, South Melbourne, wrote in 1897 re an adopted child of Mrs. KORTFELT of Collingwood, whom she looked after for awhile, and for whose car she is owed money.  She visited Mrs. Kortfelt and saw the child, and wrote of her concern for its welfare.  Police report that the child is over 3 years old and well cared for, so no action was required under the Infant Life Protection Act.  5 pages, List 26.

VANDENBERG, S.  Writes re her child Ernest Dwyer Vandenberg in 1904; she wants to leave him with her brother and sister in law, the father having absconded.  List 16.

VENNING, Rebecca, applies for registration as a nurse in 1896.  Has child Robert James JAMIESON; not recommended, Edith COLLINS died in her care.  13 pages, List 24. 

VERCOE, Mrs. A.  Carlton, 1902.  Has child William Edward ROSS, mother Ettie is in NSW.  Child previously with gradmother Mrs. COOPER.  3 pages, List 18.

VERNON, Mrs. A.  Korong Vale, 1904.  Wants to take daughter’s illegitimate child, sent to Mrs. PICKERING at Bendigo, but daughter can’t afford to pay, Mrs. Vernon has 18 children of her own.  List 16.

VINCE, Rose.  Gave birth to Rose in Fitzroy in 1904; child’s birth not registered within 3 days, so Clara PORTER, occupier of house, charged.  Rose lived with Thomas CHURCHILL.  Case dropped as she told Porter she was married.  8 pages, List 25. 

VINCENT, Dorothy.  Daughter of Mary, left with nurse Kate SUTTON, 1899, but given back to mother.  6 pages, List 3.

VINCENT, Mrs. Elizabeth Mary.  Of Fitzroy, applied in 1901 for an exemption to register, she had taken dead sister’s child.  List 12.

WADE, Clara Arabella, 26 years, gave birth to illegitimate child John Patrick at grandmother Amelia Louise’s home in Newtown Geelong in 1896.  Amelia thought she had to register as a nurse, but this wasn’t necessary.  Child died 2 weeks later, but no inquest necessary.  7 pages, List 25.

WALKENDEN, Louisa, Queen St., Melbourne, wants to adopt child Lorna Doris MARTIN, mother of child is a widow.  Subsequently changes mind.  5 pages, List 22.

WALKER, Emma of Collingwood.  Adopted Florence, child of Adelaide BURSTON of Clifton Hill, in 1905.  6 pages, List 6.

WALLACE, Ann, of Osborne St., Williamstown, wrote in 1904.  She was looking after her husband’s cousin’s child, whose mother had died leaving four young children, the youngest 3 months.  Asks if required to register.  8 pages, List 6.

WALLACE, Mrs. Elizabeth, Clifton Hill, wishes to adopt Reta EDWARDS in 1903, her son is the father.  4 pages, List 5.

WARREN, Catherine, Benalla, applies for registration, nursing midwifery and other cases for 6 years.  Reference from local Dr. BARRINGTON and Rev. W. PARKES on file.  Police report she is a respectable woman, but husband has recently been discharged from prison.  List 16.

WARREN, Minnie, St Arnaud, charged in 1905 with failure to register illegitimate birth within required time; her daughter May is the mother, 6 pages, List 7.

WHEELER, Lillie, wrote from South Melbourne in 1896, wishes to adopt James Frederick TOLEMAN.  Report states living with – FLEMING, recently fined for being unregistered nurse.  Mother Jessica Toleman changes mind.  9 pages, List 25.

WHEELER, Mary Ann.  Left her illegitimate child Harry with nurse Mrs. BOND in Carlton in 1898, but had not paid maintenance, despite sending 3 letters that she would.  Police track her background; taken from Industrial School by Mrs. A. GAMBLE of Coburg when a baby and kept until 16 when sent to various people as a servant, gave birth to illegitimate child c1892 and again c1895.  Not found; nurse gets child committed to Industrial School.  33 pages, List 18. 

WHELAN, Clementine, married.  Applies to register.  Is living at the Myrtle Hotel  South Melbourne where her mother is licensee.  Adopts child Mary Margaret KELLY, mother Margaret of Devenish.  7 pages, List 19.

WOODWARD, Byrel Melville.  Adopted by Mrs. Emily WILSON of Golden Square Bendigo in 1899; her own child had died.  13 pages, List 17.

WOOLCOCK, Eva.  Eliza Charlotte DALTON of Brunswick charged in 1906 with adopting Eva, daughter of Emily, when not registered as a nurse. 23 pages, List 10.

WOOLLEY, Thomas Charles.  Charged with failure to register birth of illegitimate child Mary JOHNS in 1904, her mother Grace is living with him in Fitzroy, Lit 17.

WRIGHT, Mrs., Albert Park, informs police in 1897 that Lily BOYD has been removed from her care by her mother Milly, of Richmond.   Police interview Milly’s sister Mrs. McEVOY, in an attempt to find her, and are informed she has gone to join her father Alfred in New Zealand with the child.  3 pages, List 26.

YELVERTON, William Francis. Son of Margaret of Carlton. With a nurse in Melbourne; April 1899 Monthly Report, June 1899 Monthly Report and May 1900 Monthly Report.

YOUNG, Violet.  Adopted by Mrs. A.M. WALKER of Brunswick in 1908.  Mother Josephine SMITH lives in Tarnagulla.  Mention of Benjamin HUGHES, wealthy middle-aged man.  List 11.

YOUNGER, Ethel.  Kew, applies for registration as a nurse, 1904.  2p, , List 6.

YOUNGSON, Mrs. Alice, applied for registration as a nurse, is looking after Harold, 4 years, and John, 1 year, sons of Mrs. NICOL, who had a wine shop in Fitzroy in 1896.  11 pages, List  25.

Infant Life Protection Act of 1890

INFANT LIFE PROTECTION ACT OF 1890.

In 1898, Victoria Police took over the administration of the Infant Life Protection Act of 1890, which  had been passed in reaction to cases of infanticide and abuse by baby farmers (women who took in babies to nurse). This legislation tightened controls on both mothers and baby farmers. The police department managed the administration of the Act until 1908, and in so doing created a series of records of immense use to family and social historians. Unfortunately there is no surviving index to the records prior to 1901, making it a difficult task to access them.  Those cases found in files for the period 1898-1900have now been placed on a separate web page Infant Life Protection Act Indexes Please note that they are not all the cases, merely the ones found to date.

From 1901, there exist indexes to the correspondence registers, and the registers themselves.  This series of microfiche has been compiled from both the indexes and the registers, and gives names, locations and relevant file numbers to enable access to the files themselves.  The indexes, registers and files are housed at the Public Record Office, but unfortunately the latter are not always easy to locate, with many not located where they should be.  The microfiche also offers a guide to where to look for the files.

ILPA PART ONE  – THE NURSES 1901-1908

Contains over 5,000 entries listing the name and location of women (and the occasional male) who applied to become ‘nurses’, who renewed their registration or who notified the department of their change of address.

ILPA PART TWO – ILLEGITIMATE BIRTHS

Lists those people who were charged with failing to register the birth of an illegitimate child within the required three days. The legal responsibility to register the child lay with the occupier of the house in which the child was born, rather than the mother, so friends or relatives could be and were charged.

ILPA PART THREE – THE CHILDREN & THEIR NURSES

This list contains two indexes; the names of the children who were given to nurses registered under the Act, and the names of the nurses and which children they took into their care. A number of the children were the offspring of women from country areas and interstate or overseas (New Zealand), who came to Melbourne to give birth, leave the child with a nurse, then return home with their secret intact.

ILPA PART FOUR – ADOPTIONS

Most of the children (although not all) were the illegitimate offspring of working-class mothers, unable to look after babies themselves, and amenable to other people adopting their child. This list shows both the child’s and the adoptive parents’ names. As legal adoption did not commence until 1928, the material in these files is the only way in which these adoptions can be traced.

ILPA PART FIVE – DEATHS

Lists those children who died while in the custody of a nurse registered under this Act, and includes those people who were investigated for failing to comply with the Act. These people were sometimes the nurse herself, sometimes relatives or adoptive parents.

ILPA PART SIX – NURSES – MISCELLANEOUS.

Lists women who were investigated by the police department for taking in children when they were not registered as nurses under this Act; women who applied for an exemption because of extenuating circumstances (such as being a relation of the child) and women whose registration as nurses were cancelled, sometimes at their own request and sometimes because of their treatment of the children under their care.
